Terms of Use

These Terms of Use ("Terms") govern your use of Botanist. By using the app, you agree to these Terms. If you do not agree, please do not use Botanist.

The service

Botanist is a plant-care app that helps you track plants, get reminders, adapt watering to the weather, and get AI-based plant identification and problem diagnosis. Botanist is operated by Giglab Limited ("we", "us", "our").

Your account

You sign in with Google. You are responsible for activity under your account and for keeping your login secure. You must be at least 13 years old (or the minimum age required in your country) to use Botanist.

Your content and the license you grant us

You keep ownership of the plants, photos, and information you add ("Your Content"). By adding Your Content to Botanist, you grant us a worldwide, non-exclusive, royalty-free license to host, store, and display it so we can operate the service, and to feature it in our marketing and promotional materials, including our website, app-store listings, and social media.

When we feature Your Content publicly, we will credit you by your first name or display name only. You confirm that you own or have the rights to the content you upload and that it does not infringe anyone else's rights. You can ask us to stop featuring your content at any time by emailing support@botanistapp.com.

Acceptable use

Do not misuse Botanist. For example, do not: break the law; upload content you do not have the rights to; upload harmful, offensive, or infringing content; attempt to disrupt, overload, or reverse-engineer the service; or use it to harm others.

AI features and no professional advice

Plant identification and diagnosis are generated by AI and provided for general guidance only. They may be inaccurate or incomplete and are not professional horticultural, agricultural, veterinary, medical, or safety advice. You are responsible for how you care for your plants. Do not rely on Botanist for decisions where an error could cause harm, for example whether a plant is safe for pets or people to touch or eat.

Availability and changes

We may add, change, suspend, or remove features at any time, and we may update the app and these Terms. Reminders and other notifications depend on your device and network, and we cannot guarantee they will always be delivered on time.

Disclaimer of warranties

Botanist is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that AI results, reminders, or recommendations will be accurate or reliable.

Limitation of liability

To the maximum extent permitted by law, Botanist and Giglab Limited will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, plants, goodwill, or profits, arising out of or related to your use of, or inability to use, Botanist. To the maximum extent permitted by law, our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 50.

Indemnification

You agree to indemnify and hold harmless Botanist and Giglab Limited from any claims, damages, or expenses arising out of Your Content, your use of the service, or your violation of these Terms.

Termination

You can stop using Botanist and delete your account at any time from our self-service deletion page. We may suspend or terminate accounts that violate these Terms.

Governing law

These Terms are governed by the laws of Kenya, without regard to its conflict-of-laws rules.
